General Terms of Service (ToS)

PLEASE READ THESE TERMS OF SERVICE CAREFULLY.
These Terms of Service (the “Agreement”) are an agreement between netpoa.com (“NETPOA LTD” or "NETPOA" or “us” or “our”) and you (“User” or “you” or “your” or "Client" or "Customer"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by NETPOA Ltd and of the netpoa.com or netpoa.co.tz websites (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.
1. Account Setup and Contact Information
- You must provide a valid email address and phone number during signup.
- NETPOA communicates important updates and notices via email, SMS, or WhatsApp. You are responsible for keeping your contact information up to date.
- If you are registering a domain, the real owner's contact details must be submitted for compliance with registry requirements (TCRA/TZNIC).
2. Payments, Refunds and Renewals
All services are billed in advance and must be paid on or before the due date to avoid suspension.
Please note that domain names and hosting services are not renewed automatically. It is your responsibility to ensure timely renewal before expiry to prevent service disruption.
We support both automatic online payments and manual offline payments:
- Automatic Payment: Clients can pay directly online using integrated payment options through our client portal.
- Offline Payment: Clients can pay manually via bank transfer, mobile money, or other accepted methods, and must share proof of payment (POP) via email (info@netpoa.com) or WhatsApp (0755 212 222).
Please note that offline/manual payments may take time to verify. We kindly ask for your patience during this process, and remind you that your order or service will only be activated after confirmation.
NETPOA is not responsible for any loss or damages resulting from expired services.
Please read carefully Section 8 on Suspension and Termination policies to understand how service interruptions and account deletions are handled.
2.1. Cancellations
Clients may cancel a service at any time by submitting a cancellation request via the client portal. Cancellation requests must be made before the next billing cycle to avoid future charges. Other methods of cancellation are not valid. Once the form submitted account will be cancelled within 24 hours.
2.2.Refund Policy & Money-Back Guarantee
NETPOA offers a 7-day money-back guarantee for first-time shared hosting accounts only. This guarantee does not apply to domain name registrations, renewals, VPS, dedicated servers, or any custom services.
All payments made to NETPOA are considered final. Refunds will not be issued unless explicitly stated under a specific promotion or agreement. Refunds are processed at NETPOA’s sole discretion.
No refunds will be issued for accounts that are suspended or terminated due to:
- Violations of our Terms of Service
- Involvement in spam or phishing activities
- Malware distribution or abusive behavior
By using our services, you agree to this refund policy.
3. Abuse, Spam, and Malware Policy
- Sending unsolicited emails (spam), hosting malware, phishing sites, or participating in any abusive or illegal activity is strictly prohibited.
- If your account is found to contain malware or is sending spam emails, NETPOA reserves the right to suspend or permanently delete the account without refund.
- A reactivation or cleanup fee may be required to restore services after such violations.
4. Acceptable Use
- You may not use our services to host or promote:
- Illegal content (including copyrighted materials without permission)
- Hate speech or violent content
- Adult content (unless on a VPS or dedicated server and approved)
- Resource-intensive applications without prior approval
- NETPOA reserves the right to determine what constitutes a violation.
4.1 Email Service Limits
- Shared hosting accounts may not be used to send bulk emails, newsletters, or marketing campaigns.
- For bulk emails, we recommend third-party services such as Mailchimp or Elastic Email.
- Abuse of email service may lead to account suspension.
5. Hosting Plan Changes
5.1 Upgrades
- Clients may request to upgrade their hosting plans at any time.
- All upgrades are subject to availability and applicable pricing adjustments.
5.2 Downgrades
- We currently do not support downgrades to our smallest hosting package, as it is intended exclusively for new orders.
- Clients may request a downgrade to an eligible lower-tier package, subject to review and approval.
- Downgrade requests must be submitted at least one month before the end of the current billing cycle.
- Requests made outside this period may not be processed until the next renewal term.
- All downgrade requests must be submitted through official support channels and may involve adjustments to allocated resources, features, and billing.
6. Resource Usage
- Clients must not use excessive CPU, memory, or disk I/O on shared hosting plans.
- Accounts abusing system resources may be limited, suspended, or advised to upgrade to a VPS or dedicated plan.
7. Backups
NETPOA performs regular backups of client data for internal use and disaster recovery purposes. However, these backups are not guaranteed and may be deleted without prior notice under certain circumstances, such as infrastructure changes, provider migrations, or prolonged non-payment.
Clients are strongly advised to maintain their own up-to-date backups of all important data. NETPOA is not responsible for any data loss, corruption, or unavailability resulting from backup failure, deletion, or termination of service.
In case of account termination due to non-payment, client data will be retained on backup servers for up to 3 months, during which data recovery may be requested by paying the applicable recovery fee along with the hosting renewal fee. Recovery is not available for accounts terminated due to Terms of Service violations such as malware distribution, abuse, or spamming.
Please ensure timely payment to avoid loss of data and service.
8. Hosting Account Suspension, Termination & Data Recovery Policy
- Accounts may be suspended or terminated for:
- Non-payment
- Violation of Terms
- Resource abuse
- Security risks
8.1. Service Suspension Due to Non-Payment
NETPOA reserves the right to suspend access to services if an invoice remains unpaid past the due date. Suspension may occur immediately without further notice. During suspension, all services including websites, emails, and databases may become inaccessible. A reactivation fee may apply to restore the services.
8.2. Service Termination for Overdue Payments
If payment remains overdue for 1 month after the due date, NETPOA may permanently terminate the affected service(s). Terminated accounts may have all data deleted and will not be recoverable. NETPOA shall not be held responsible for any loss resulting from such termination.
At NetPoa, we value clarity and accountability. Below is the structured timeline we follow for hosting account billing, suspension, termination, and data recovery:

Please note that if your domain name expires (e.g.
yourcompany.co.tz
), your website and email services may go offline immediately — even if your hosting account is still active, within the grace or suspension period. We strongly recommend renewing your domain name on time to avoid unexpected downtime.8.4 💰 Data Recovery Fees
- Accounts using 0 – 50GB: TZS 30,000 (≈ $15 USD)
- Accounts over 50GB: TZS 60,000 (≈ $30 USD)
⚠️ Important Recovery Disclaimer
We do not guarantee recovery of your data. Under certain circumstances, such as switching backup providers or major infrastructure changes, your data may be lost or deleted during the transition. If your account is marked for termination during such events, it may not be moved or archived.
To avoid data loss, please ensure you pay and renew your account before the termination deadline.
Note: Recovery is only processed after full payment of both the recovery fee and the hosting renewal for your package.
8.5 ❌ No Recovery for Terms of Service Violations
Accounts terminated due to serious violations of our Terms of Service are not eligible for data recovery. This includes, but is not limited to:
- Hosting or spreading malware or viruses
- Spamming or phishing activities
- Publishing or distributing illegal or abusive content
- Compromising server security or engaging in hacking-related behavior
- Using hosting for unauthorized reselling

- No refunds are issued after termination for cause.
- NETPOA reserves the right to refuse service to anyone.
9. Service Availability
- While NETPOA strives for 99.9% uptime, we cannot guarantee uninterrupted service due to maintenance, technical issues, or factors beyond our control.
10. Limitation of Liability
- NETPOA shall not be held liable for:
- Loss of data, revenue, or business
- Downtime or service interruptions
- Unauthorized access or damages
11. Privacy Policy
We respect your privacy. NETPOA does not sell, rent, or trade your personal information to third parties.

12. Changes to Terms
- NETPOA may update these Terms at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of any changes.
13. Service Modifications
- NETPOA reserves the right to modify, suspend, or discontinue any service (or any part of the service) at any time with or without notice.
- We may add or remove features, upgrade infrastructure, or make changes to pricing or packages.
- If a major change affects your account or service, we will do our best to notify you in advance through email or other contact methods you provided.
- Continued use of the service after any modification constitutes your acceptance of the changes.
14. Governing Law
- These Terms are governed by the laws of the United Republic of Tanzania.
- Any disputes will be handled in Tanzanian courts under applicable laws.
